Program Overview – HD Hyundai Infracore North America, LLC. is seeking User Generated Content submissions (Submission) to use in various ways including in our marketing programs and on our social media platforms (Program). Thank you for considering sending us a Submission! By responding to our request in any affirmative manner, including replying with “Yes” or other responses identified by HD Hyundai Infracore North America, LLC., or by uploading content to our websites, mobile sites, or social media sites (Channels), you are making a Submission (as defined below) to HD Hyundai Infracore North America, LLC.and/or its direct and indirect affiliates, subsidiaries and dealers (collectively “HD Hyundai Infracore North America, LLC.,” “we” or “us”), and you agree to the following Terms and Conditions.
If your Submission is selected by HD Hyundai Infracore North America, LLC., it may be displayed or appear on the Channels or in other marketing, advertising or promotions together with your name and other identifying information provided, including without limitation any social media identifier, handle or profile picture. Terms of Use – By providing us your Submission, you hereby grant us a non-exclusive, royalty-free, worldwide, perpetual, transferable, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, sell, assign, translate, create derivative works from, distribute and display any Submission in whole or in part, as well as your name and other identifying information. This identifying information includes without limitation any social media identifier, handle, profile picture, image, likeness, posts, statements or other information available or provided by you, in any form, media or technology, whether now known or hereafter developed in connection with the HD Hyundai Infracore North America, LLC. marketing, advertising and promotional activities referred to above.
Submission Eligibility – To be eligible for the Program, you and your Submission must meet the following requirements:
You represent and warrant that your Submission complies with all of these Terms & Conditions and that you have obtained the necessary consent from any third party shown or referenced in your Submission.
Release – By participating, you release and hold harmless HD Hyundai Infracore North America, LLC. and its respective parent, Hyundai Doosan Infracore, subsidiaries, affiliates, dealers, related companies, directors, officers, employees and agents (collectively, the “Releasees”) from any and all liability for any injuries, loss or damage of any kind arising from, or in connection with, the Program. You agree to indemnify and hold Releasees harmless from any and all claims, damages, loss, injury, expenses and costs (including reasonable attorneys’ fees), brought or asserted by any third party against any of the Releasees due to or arising out of your Submission or participation in the Program including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation.
Changes to Terms and Conditions – We reserve the right to modify or terminate these Terms and Conditions for any reason without notice and without liability to you or any third party. You are responsible for regularly reviewing these Terms and Conditions so that you will be apprised of any changes.
HD Hyundai Infracore North America, LLC. reserves the right, at its sole discretion, to edit any Submission and to choose to include, not include or remove such Submission from its Channels or in any other materials where the Submission may appear.
